CityWeave: Auckland Digital Twin — Terms of Use
Version 1.9 · effective 7 November 2026
These terms apply to your use of CityWeave: Auckland Digital Twin ("CityWeave"), a service of AG++ Studio, Auckland, New Zealand. In these terms, "AG++ Studio" includes its owners, directors, officers, employees, contractors, agents, successors and licensors.
1. Agreement
By ticking the box and pressing Enter you agree to these terms. You confirm you have had the chance to read them and to take advice. You must be 16 or older, or have a parent or guardian agree for you. If you use CityWeave for an organisation, you confirm you may bind it. Your agreement is remembered on your device for 12 months for this version. If you do not agree, do not use CityWeave.
2. Beta version, open for a limited time
CityWeave is a beta (test) version, open to public use for a limited time with no charge. It is experimental and provided "as is" and "as available". Its maps, numbers and 3D views are rough, indicative information for learning and early exploration. They are not live measurements, not professional advice, and not for any decision. AG++ Studio gives no warranty, express or implied, that anything is accurate, complete, current, available, secure, error-free or fit for any purpose.
3. Your licence
You get a limited, personal, non-exclusive, non-transferable, revocable licence to use CityWeave in your web browser for lawful personal, educational, research or early-stage professional exploration. Nothing else is licensed. Use during the beta creates no client, adviser, customer, agency or partnership relationship, and AG++ Studio owes you no duty beyond these terms. Paid studies are only under a separate written agreement.
4. What you must not do
You must not:
- scrape, crawl, bulk download or harvest data, images, tiles or results, or use bots or scripts to access the twin or the services behind it;
- copy, republish, sell, sublicense, mirror, frame or build a competing or derivative service from CityWeave or its content;
- reverse engineer or try to extract source code, models, methods or underlying data, except where the law does not allow this to be restricted;
- interfere with, overload, probe, test the security of, or bypass any limit or protection of CityWeave, its hosting or connected services;
- use it unlawfully, to harm others, or to suggest that AG++ Studio or any data provider endorses you;
- use it, or anything produced from it, as evidence or support for a resource consent, building consent, Building Code or other compliance matter, hazard, flood, geotechnical or engineering assessment, insurance, valuation, tender, or any regulatory, legal or contractual submission; or
- use it for decisions affecting health, safety, life or property, or in any safety-critical or emergency setting.
This does not restrict anything the law, or a third-party data licence (for example CC BY 4.0 or ODbL), allows you to do with third-party data. You may share a link to CityWeave, and screenshots or exports for non-commercial purposes if you keep the credits and screening notice shown on them and do not suggest the results are accurate or endorsed. You keep the scenarios and files you create.
5. Ownership and credits
AG++ Studio and its licensors own the original CityWeave software, interface, design, text, name and logo. All rights reserved. Maps, imagery, 3D mesh, elevation, building, census, weather and other data, and software libraries, belong to their owners and are used under their own licences, shown in the twin (Scene info) and its Methods page. Historical reference weather contains modified Copernicus Climate Change Service information (ERA5-Land reanalysis, ECMWF, DOI 10.24381/cds.e2161bac, CC BY 4.0); neither the European Commission nor ECMWF is responsible for any use of it. You must follow those licences. Third-party licensors give no warranty through AG++ Studio and do not endorse CityWeave.
6. You rely on it at your own risk
Everything in CityWeave is indicative only. Historical, modelled, assumed and reanalysis values are not live measurements; station readings are single points and may be delayed or missing; building heights, shapes, tree cover and 3D geometry may be approximate, outdated or wrong; imagery shows a past capture; what-if tools are simplified and do not predict real outcomes. AG++ Studio does not intend you to rely on CityWeave and it is not reasonable to do so. You use it, and anything you decide or do because of it, entirely at your own risk. Get qualified professional advice and official sources before any decision that matters.
7. Release, exclusion and limit of liability
7.1 Rights that cannot be excluded. Nothing in these terms excludes or limits any right or guarantee that cannot lawfully be excluded or limited, or liability for fraud or wilful misconduct. Each limb below is separate and applies as far as the law allows.
7.2 Exclusion. To the maximum extent permitted by law, AG++ Studio is not liable to you or anyone claiming through you, in contract, tort (including negligence and negligent misstatement), equity, statute or otherwise, for any loss, damage, cost or claim arising from CityWeave, its use, inability to use, content, errors, outages or third-party material. This includes direct, indirect, consequential, special and economic loss, and loss of profit, revenue, data, goodwill, opportunity or savings.
7.3 Release and no claims. To the maximum extent permitted by law, you fully and unconditionally release AG++ Studio from all claims and liabilities arising from your use of CityWeave, known or unknown, and you agree not to bring any claim, demand or proceeding against AG++ Studio in connection with it.
7.4 Cap. Because CityWeave is a beta version offered for a limited time with no charge, AG++ Studio's total liability for all claims is nil. If a court holds that a nil cap does not apply, it is limited to NZ$100, and if that is not permitted, to the smallest amount the law allows.
7.5 Contributory fault and outside control. AG++ Studio is not liable for loss caused by your own breach, error or failure to read the limits shown in the twin, or by events beyond its reasonable control, including outages of hosting, networks or third-party providers, withdrawal of third-party data or licences, cyber-attack, power or internet failure, natural disaster, pandemic, government action or changes in law.
7.6 Personal injury. Under the Accident Compensation Act 2001, claims for compensatory damages for personal injury covered by that Act are generally barred. These terms do not change that.
7.7 Business users. If you use CityWeave in trade, for a business or for an organisation, you confirm CityWeave is supplied to you in trade and agree it is fair and reasonable that the Consumer Guarantees Act 1993 and sections 9, 12A, 13 and 14(1) of the Fair Trading Act 1986 do not apply, to the extent the law allows contracting out of them. Sections 7.2 to 7.5 apply to you in full.
7.8 Indemnity. If you use CityWeave in trade, you will compensate AG++ Studio for loss, costs and claims (including reasonable legal costs) it suffers or faces because you breach section 4 or 8, infringe anyone's rights, use CityWeave unlawfully, or because anyone claims through you. Any claim by you must be notified in writing with full details within 12 months of when you first knew of it, to the extent the Limitation Act 2010 allows.
8. Files you import
Anything you import or enter is processed in your browser. You confirm you have the right to use it, that it is lawful and contains no malware or personal information of others. You keep ownership of it and give a limited licence to process it in your browser to run the features you choose. Imported or assumed values are your responsibility.
9. Third-party services
CityWeave connects to third-party map, imagery, data and weather services and may link elsewhere. They have their own terms and privacy practices. AG++ Studio does not control them, gives no promise about them and may remove or replace them at any time.
10. Changes and ending
AG++ Studio may change, limit, suspend or discontinue CityWeave or any feature at any time, and may block access if you breach these terms. It may update these terms; changes apply under the new version shown at the top, and you will be asked to agree again to a material update. If you do not agree, your only remedy is to stop using CityWeave. Sections that by their nature should continue (including 4 to 8 and 11) survive ending.
11. General
- Whole agreement. These terms and the Privacy Notice are the whole agreement about CityWeave. This does not exclude liability for misleading statements, and nothing here limits a right that cannot be excluded.
- Severable. Each clause, and each limb of section 7, is separate. If any part is invalid or unenforceable it is read down as far as needed or removed, and the rest continues in full. Where a limit cannot apply to you in full, the next narrower limit applies instead.
- No waiver; assignment. Failure to enforce a term is not a waiver. You may not transfer your rights; AG++ Studio may transfer its own, for example to a company it forms.
- Notices. Notices may be given by posting them in the twin or on this page. You may write via the contact page.
- Concerns first. Contact AG++ Studio first and allow 20 working days to try to resolve a concern before starting any proceeding.
- Law and courts. New Zealand law governs these terms and the New Zealand courts have non-exclusive jurisdiction. Mandatory consumer law giving you rights in your own country is not affected.
